Privacy Policy

This policy explains what personal information Fluxergy collects through its websites, why we collect it, who we share it with, and the choices you have. Please read it together with our Terms of Use.

1.Who we are and what this covers

Fluxergy, Inc. (“Fluxergy”, “we”, “us”) is a diagnostics company with its headquarters at 15 Musick, Irvine, California 92618. We are the controller of the personal information described in this policy.

This policy covers fluxergy.com, veterinary.fluxergy.com, and any other web page that links to it. It does not cover the data you process inside a Fluxergy product. If you run tests on a Fluxergy analyzer or use FluxOS under an agreement with us, the handling of the data in that product is governed by that agreement, not by this policy.

It also does not cover websites we do not operate. Our pages link out to other organizations, and those organizations have their own policies.

2.What we collect

Information you give us. When you fill in a form on this site, you give us the details in the fields you complete. Today that means your first and last name, your work email address, your phone number, your company, and anything you write in the message box. If you email us, apply for a job, ask for support, or meet us at a conference, we keep the information you provide in that exchange.

Information we collect automatically. When you visit the site, our hosting provider and our analytics receive standard technical information about the request:

  • Your IP address, and the approximate region it indicates
  • Your browser and operating system, and the type of device you are using
  • The pages you visit, when you visit them, and how long you stay
  • The page or search that sent you to us

Information from other sources. We use HubSpot as our customer relationship system, and HubSpot adds publicly available business information to the contact records we create, such as a company size or industry. We also receive contact details from events we take part in and from people who refer colleagues to us.

We do not ask for and do not want sensitive information through this website. Do not send us patient information, protected health information, test results, or anything confidential through a web form or an unencrypted email. If you need to share something of that kind, write to us at legal@fluxergy.com and we will arrange a secure route for it.

3.How we use it

When you submit a form on this website, you agree that we may store the information you provide and use it to contact you. Specifically, we use personal information to:

  • Respond to your enquiry, and to schedule and run a demonstration
  • Contact you by email, telephone, or text message about our products and services, including follow-up from our sales team
  • Send you marketing communications, such as product announcements, newsletters, event invitations, and technical material we think is relevant to your work
  • Qualify and manage enquiries, including recording which pages you read before you contacted us, so that the person who calls you has useful context
  • Provide support, fulfil orders, and administer agreements with your organization
  • Operate, secure, and improve the website, including detecting and blocking automated submissions
  • Meet our legal, regulatory, and quality obligations, and establish or defend legal claims

You may ask us to stop sending marketing at any time, and we will. See the next section.

4.Your marketing choices

Every marketing email we send carries an unsubscribe link, and using it stops marketing email to that address. You can also write to legal@fluxergy.com and ask us to stop, or ask the person contacting you to take you off the list.

Unsubscribing from marketing does not stop messages we send because you asked us something or because you have an agreement with us: a reply to your enquiry, a quotation, an order confirmation, or a support or safety notice.

6.Who we share it with

We do not sell your personal information. We share it with:

  • Service providers who run parts of this site and our operations on our behalf, under contracts that limit what they may do with it. They include HubSpot, which holds our contact records and sends our marketing email; Vercel, which hosts and serves the site; and Supabase, which stores the site's content.
  • Our professional advisers, such as lawyers, auditors, and insurers, where they need it to advise us.
  • Distributors or partners, where you ask us for help in a market one of them covers and we need to pass your enquiry on. We will tell you when that happens.
  • A buyer or successor, if we are involved in a merger, acquisition, financing, or sale of assets. Personal information is one of the assets that would transfer.
  • Authorities and other parties, where we are required to by law, or where we need to in order to establish, exercise, or defend a legal claim, or to protect the safety of a person.

7.Cookies and tracking

We use HubSpot's tracking script on the public pages of this site. It sets a cookie in your browser that identifies it to us on later visits, which is how an enquiry arrives with the pages you read attached rather than as a name and an address on its own. Our hosting provider also sets cookies that are necessary for the site to work.

You can refuse or delete cookies in your browser settings, and most browsers let you block them for a single site. The site works without them; what you lose is the continuity between what you read and what you ask us.

We do not currently respond to browser Do Not Track signals, because there is no agreed standard for what a website should do when it receives one.

8.How long we keep it

We keep enquiries and contact records for as long as there is a business relationship, and then for as long as we may need them for legal, tax, quality, or audit purposes. Where there is no relationship and no obligation to keep a record, we delete or anonymize it. You may ask us to delete your information sooner, and we will unless we are required to keep it.

9.How we protect it

The site is served over HTTPS, access to our systems is limited to the people who need it, and the services we use hold recognized security certifications. No website or system is perfectly secure, so we cannot guarantee the security of information you send us over the internet — which is the reason for the warning above about what not to send through a web form.

10.Where your information goes

Fluxergy is based in the United States, and the services we use store information there. If you are outside the United States, submitting information to us means sending it to a country whose data protection laws may differ from your own. Where UK or EU law requires a transfer safeguard, we rely on the European Commission's standard contractual clauses and the UK addendum to them.

11.Your rights

Wherever you are, you may ask us what personal information we hold about you, ask us to correct it, ask us to delete it, or ask us to stop sending you marketing. Write to legal@fluxergy.com and we will answer. We may need to verify who you are before we act, and we will not treat you differently for asking.

California. If you are a California resident, the California Consumer Privacy Act gives you the right to know what personal information we have collected about you, where we got it, why we collected it, and who we disclosed it to; the right to have it deleted; the right to have it corrected; and the right not to be discriminated against for exercising any of those rights. The categories we collect are identifiers, commercial information, internet activity, and professional or employment-related information, each described in more detail above. We do not sell personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined in that Act. You may use an authorized agent to make a request on your behalf, and we will ask for proof of their authority.

United Kingdom and European Economic Area. In addition to the rights above, you may ask us to restrict how we use your information, object to our using it on the basis of legitimate interests, and ask for a copy of it in a portable format. You also have the right to complain to your national data protection authority, and in the United Kingdom to the Information Commissioner's Office.

12.Children

This site is for people working in laboratories, clinics, practices, and industry. It is not directed at children, and we do not knowingly collect personal information from anyone under 16. If you believe a child has given us information, write to legal@fluxergy.com and we will delete it.

13.Changes to this policy

We update this policy when what we do changes, and the date at the top is the date of the most recent change. If a change materially affects how we use information we already hold, we will take reasonable steps to tell you before it takes effect.

14.How to contact us

For anything in this policy, including a request about your own information, write to legal@fluxergy.com, or to Fluxergy, Inc., 15 Musick, Irvine, California 92618, United States.
